It seems Apple has not done enough to satisfy a few iPod Nano buyers. Those little tiny iPod Nano seem to be quite prone to scratches and a few customers are taking Apple to task for the scratches.

After excessive scratching on a second Nano the lead plaintiff, Jason Tomczak represented by Hagens Berman Sobol Shapiro and David P. Meyer & Associates., has filed a class action suit alleging Apple violated California’s consumer protection statutes. They are seeking damages including the price paid for the nanos, statutory and punitive damages, and attorneys’ fees.
